These Terms of Service (the “Terms”) explain the rules for using the EnergyNetWatch website, application, data products, reports, exports, application programming interface (“API”), Model Context Protocol (“MCP”) tools, and related services (collectively, the “Service”). “EnergyNetWatch,” “we,” “us,” and “our” refer to the EnergyNetWatch service. “You” means the person or organization using the Service.
1. Agreement and eligibility
You accept these Terms when you create an account, complete a checkout that links to them, access a paid product, or use the Service after being shown the Terms. If you use the Service for a company or another organization, you represent that you are authorized to accept these Terms for that organization.
You must be at least 18 years old and legally able to enter into this agreement. If you do not accept these Terms, do not create an account, complete checkout, or use the Service.
2. The Service and your account
EnergyNetWatch organizes oil and gas information into source-aware research, mapping, monitoring, reporting, export, API, MCP, and assistant workflows. Available features, sources, geographic coverage, update schedules, usage limits, and access levels depend on the product or plan attached to your account.
You must provide accurate account and billing information, keep your credentials and API keys secure, and promptly notify us at info@energynetwatch.com if you suspect unauthorized access. You are responsible for activity performed through your account or credentials.
Do not share a personal login or API key with an unauthorized user. Employees and contractors working for your organization may use EnergyNetWatch output for your permitted internal business purposes, but each person who accesses the Service must use an access method authorized by the applicable plan.
3. Permission to use the Service
While your account has the required access, EnergyNetWatch gives you a limited, non-exclusive, non-transferable, and revocable right to use the Service for your own internal business research, analysis, operations, planning, and decision support.
You may:
- Use the application’s maps, tables, reports, alerts, projects, assistant features, and exports.
- Use documented API endpoints and MCP tools within your account’s scopes, rate limits, unit balance, and other technical controls.
- Use results in internal dashboards, internal analysis, customer relationship management workflows, and internal reports.
- Share a reasonable excerpt or result with an employee, contractor, adviser, or customer when it supports your own work and does not function as redistribution or resale of an EnergyNetWatch dataset.
Public-facing products, resale, redistribution, bulk data delivery to third parties, or use of EnergyNetWatch data as a separately marketable dataset requires our written approval or a separate agreement.
4. Uses that are not allowed
You may not:
- Sell, sublicense, publish, or redistribute raw EnergyNetWatch datasets, bulk exports, API responses, or substantially complete collections unless we approve that use in writing.
- Share credentials, impersonate another person, or allow an unauthorized person to use your account.
- Scrape or automate access outside the documented API, MCP tools, exports, or other interfaces that we provide for that purpose.
- Avoid or interfere with authentication, usage metering, access controls, rate limits, security controls, or technical restrictions.
- Reverse engineer the Service, attempt to extract non-public source code, or use the Service to build a substantially similar competing database or product.
- Introduce malware, overload the Service, probe for vulnerabilities without written authorization, or interfere with another customer’s use.
- Use the Service or its output for unlawful, fraudulent, deceptive, or abusive activity.
Documented API and MCP automation is permitted. This section does not prohibit normal integration, analysis, caching, or agent workflows that stay within the access and commercial-use rights granted to your account.
5. Source records, analysis, and assistant output
EnergyNetWatch works with government, regulatory, company, licensed, and other identified source records. Source systems can contain errors, omissions, duplicate records, reporting delays, later corrections, inconsistent identifiers, or incomplete geographic and historical coverage. Update timing varies by source.
EnergyNetWatch may organize, match, summarize, score, map, or infer relationships from those records. A map location, alert, match, score, project signal, assistant response, or generated report is an evidence aid, not a guarantee that an event occurred or that an ownership, operating, construction, regulatory, or commercial status is current.
Review source links, source dates, methodology notes, and material records before relying on an important result. The Service does not provide legal, engineering, regulatory, tax, investment, accounting, or safety advice. You remain responsible for your decisions and for deciding whether additional professional or primary-source review is appropriate.
Assistant and AI-generated output may be incomplete or incorrect. Do not submit passwords, payment-card information, private keys, regulated personal information, or material you are not authorized to provide.
6. Billing, cancellation, refunds, and API credits
Premium renews monthly until canceled. Stripe or another identified billing provider processes payment information and may calculate applicable taxes shown at checkout. You authorize the billing provider to charge the payment method associated with your account for the product you select. If payment fails, we may suspend paid access until the account is current.
The following billing rules apply:
- Premium is month to month. Cancel anytime. Access runs to the end of the paid month. No prorated refund.
- Prepaid API credits are not cash. Unused units are not refunded once the pack is issued.
- Refund a Stripe duplicate, or a pack that never activated (no key, 0 units).
- Credits do not expire in year one. Contact info@energynetwatch.com for billing.
Unless a checkout, order form, or separate written agreement says otherwise, prices may change only for a future billing period after notice. You are responsible for canceling before the next renewal if you do not accept a future price.
7. Your material and privacy
You retain ownership of prompts, project names, saved-area labels, files, messages, and other material that you submit to the Service (“Your Material”). You give EnergyNetWatch permission to host, process, transmit, back up, and display Your Material only as reasonably needed to provide, secure, maintain, support, and improve the Service.
You represent that you have the right to submit Your Material and that our permitted processing of it does not violate another person’s rights. Our collection and handling of personal information is described in the EnergyNetWatch Privacy Policy.
8. EnergyNetWatch ownership
EnergyNetWatch and its licensors retain their rights in the Service, including its software, design, branding, documentation, database organization, methodology, original analysis, and non-public technology. These Terms do not transfer ownership of the Service to you.
EnergyNetWatch does not claim ownership of an underlying government record merely because the Service organizes or displays it. Public-record status does not grant a right to copy or redistribute EnergyNetWatch’s software, database compilation, presentation, source matching, or original analysis.
If you send suggestions or feedback, we may use them without payment or an obligation to implement them. We will not identify you publicly as the source without permission.
9. Availability and changes to the Service
We work to keep the Service useful and available, but we do not promise uninterrupted or error-free operation. Maintenance, security events, cloud-service failures, source-site outages, source-format changes, and events outside our reasonable control may delay or interrupt the Service or a dataset.
We may add, change, suspend, or remove features, sources, coverage, usage limits, or integrations. When practical, we will provide notice of a material change that substantially reduces a paid product. We are not responsible for a public agency, data provider, or other third party changing or discontinuing its own records or service.
10. Suspension, cancellation, and termination
You may cancel Premium through the available billing tools. Cancellation stops the next renewal; paid access continues through the end of the paid month as stated in Section 6.
We may limit or suspend access when reasonably necessary to address nonpayment, a security risk, suspected unauthorized access, unlawful activity, material misuse, or a material violation of these Terms. When reasonable under the circumstances, we will notify you and provide an opportunity to correct the issue. We may terminate access immediately when continued access creates a significant security, legal, payment-fraud, or service-integrity risk.
When access ends, your permission to use the Service ends. You may lose access to saved workflows, reports, projects, alerts, keys, and account tools. Information may be retained as described in the Privacy Policy and as reasonably needed for billing, security, fraud prevention, dispute resolution, backups, and legal obligations.
Sections that by their nature should continue after termination—including payment obligations, ownership, use restrictions, disclaimers, and liability limits—continue to apply.
11. Service disclaimer
To the fullest extent allowed by applicable law, the Service is provided “as available.” EnergyNetWatch does not promise that the Service or its data will always be available, current, complete, accurate, secure, or suitable for a particular business decision. No statement outside these Terms or a signed order form creates a warranty.
Some jurisdictions do not allow particular warranty exclusions. Any exclusion in these Terms applies only to the extent the law allows.
12. Limits on liability
To the fullest extent allowed by applicable law, EnergyNetWatch will not be responsible for indirect, incidental, special, exemplary, punitive, or consequential losses, or for lost profits, lost revenue, lost data, lost business opportunity, or decisions made from source records or Service output.
To the fullest extent allowed by applicable law, EnergyNetWatch’s total liability for all claims arising from or related to the Service will not exceed the amount you paid EnergyNetWatch during the 12 months immediately before the event giving rise to the claim.
These limits do not apply where applicable law does not allow a liability to be excluded or limited.
13. Changes to these Terms
We may update these Terms as the Service or its business rules change. The updated version will be posted at https://www.energynetwatch.com/terms with a revised effective date. For a material change affecting an active paid subscription, we will provide reasonable notice through email, the Service, or the account’s billing contact.
Changes apply prospectively from the stated effective date. If you do not accept an updated term, you may stop using the Service and cancel before your next renewal. Continued use after the updated Terms take effect constitutes acceptance of the updated Terms.
14. Separate agreements and general terms
A signed order form, enterprise agreement, marketplace agreement, or other written agreement may add to these Terms. If it directly conflicts with these Terms, the signed agreement controls only for the conflicting subject and the products covered by that agreement.
If a court finds one part of these Terms unenforceable, the remaining parts continue to apply. A delay in enforcing a term is not a waiver of that term. You may not transfer your account or these Terms to another party without our written permission. EnergyNetWatch may transfer these Terms as part of a merger, financing, reorganization, sale of the Service, or similar business transaction.
